I was caught shoplifting worth 180$ merchandise in Dillards Jacksonville Fl. Its my 1st crime and i am 23 years old. i am not a US resident and on immigrant Visa. I got charged for Petit theft in violation of section 812.014(2)(e). they asked me to get a court date within 10 days. Should i just accept guilty or take a lawyer? how will it effect my immigration status?

You need a Lawyer a conviction can hurt your stay here. Talk to your Lawyer about Diverson as option. You should also (when seeking a Lawyer) find one who is also familar with immigration law as well

can you give me a general idea of how much it should cost me. and if you have any idea how much lawyer will charge me. i know its a very broad range to ask but still if you have any idea i would really appreciate that.

Also i am leaving states for like 30 days on this Thursday and i wont be able to do anything till december 25. i want to complete this process in next 4 days. I am telling you everything so that you have all the information. please give me your expert advise what should i do now. i really appreciate all your help. you guys are wonderful.

I doubt you can complete this in 4 days. Start calling Lawyers Monday AM many offer free consultations get as many as you can. When they talk to you about case they will also discuss payment rates

:(

i already have my vacation approved and i have tickets with me. i really want to complete this. if i pay it off by pleading guilty what is the harm? also can i take a date from court after December 25 or will they not allow me to leave country before i settle this case? i was told by the cop that this is a small matter and it being my 1st offense should not be that big deal. i know i am asking a lot of questions but i really need your help. please help. thanks a lot

If you walk in and plead guilty (not recommended) you will get whatever sentence Judge feels. This can result in your having a criminal record which can make your stay here a problem. Your vacation is secondary at this point

can or will judge make me go to jail or give me a fine? i know you have seen these type of cases a lot and you might know what happens usually. i am ready to pay my fine but if it involves prison i am definitely ready to take a lawyer. Also will they let me pay my fine on Monday only. i mean can i get the date same day i go there? i really have no idea of how law works here and this is the 1st time i am in this situation. you have no idea how much your assistance means to me. also if you know please give me a lawyer's number that can take my call right now or tomorrow (sunday) morning so that i can start this process as soon as possible.

Your asking me to predict future I cannot do that. I don't that court or the Judge a local Attorney will. My recommendations are go to court plead not guilty and either hire an Attorney or ask for Public defender if you qualify. Jail is not likely but is option

i am sorry if i am asking stupid questions. i really apologize for my ignorance. i have one last question. my citation states that i should take a court date from the Clerk of Circuit Court within 10 days of the citation. does this means that i have to appear in court within 10 days or i have to take a date within 10 days but the actual date of my trial can be later (like after december 25 when i come back to USA). Also if not can a lawyer help me get a date later than december 25. i really have to go somewhere that's why i am stressing on this for soo long. i dont want to cross anything that you said as i know you have told me that i should not consider going out and i apologize to bring it again. There must be something someone can do to help my situation.

i thank you again for all your time.

Call the court house about that intial date. Getting a later date is up to Judge you can request that on your first court date. Remember you commited a crime this isnt about making things easier for you! If you hire an Attorney he can appear on your behalf possibly

I have one last question. If i get into Diversion program and i get community service for like 50 hrs can i pay it off (like 5 or 10 dollars per hour) or do i have to work for 50 hours? i work full time and do evening school and was just wondering if there is a way out because i really want to get this over with. my lawyer told me that it was allowed before but he still need to make sure that this is still allowed.

Not sure what your asking. You want to pay money (in addition to fines) instead of community service? If so ask your Attorney to present this to Judge and see if he approves. Remember your being sentenced for a crime its not up to Judge ot make it easy for you. Lots of others work full time and meet their court requirments
