Hello, This past tuesday I was caught shoplifting with 2 friends of mine. One was left go with a tresspassing paper, as were we. Me and My other friend on the other hand were arrested.
-We are on each others Police affidavit. It's listed as Misdemeanor on the police report, I had 75$ worth of stuff on me, he had under 125$.Now on the daily booking site it said Misdemeanor 2ND degree pettitheft.
-How do I know if we were combined the total worth? or just what WE each did?
-I have a clean background never did anything wrong.
-What Can Happen? is there anything I can do? Can they change the charges around on me? or add anything in the police report after it was already filed?
I've tried calling those attorneys that send you papers in the mail to help me out, and there really high in price, and my friend told me that most are a scam and are just trying to freak me out.

If someone can please help me out, that either been through this or knows about any of this, it'd be appreciated.

It is the norm to combine the amounts. Example if two guys rob a bank one carries a bag with $10,000.00 and the other $15,000.00 the crime is grand theft of $25,000.00. Your worked together and left together you were a team so its one theft for total dollar value of all items in both of your possesions
-I have a clean background never did anything wrong.
The you should qualify for ACD or Diversion
-What Can Happen? is there anything I can do? Yes see last answer Can they change the charges around on me? or add anything in the police report after it was already filed? See previous answers

So we are both going to get charged with the amount under $200? Do you think we can get jail time?

Not likely. A first offense petty theft with no priors or criminal record will not likely see any jail. You need to do as I instructed to minimize the damage your actions have brought on

What does getting as many free consultations do? do I have to hire one? is it to give me knowledge? i've gotten a few, and like i said were kinda high in price. does a public deffender do the same thing? where do i get those? thanks again...

It gets you a variety of legal opinions so you can make wise choices
do? do I have to hire one?
No
is it to give me knowledge?
Yes
does a public deffender do the same thing?
Yes but they will not spend the same amount of time with you as will these others you should consult, inperson not on phone
where do i get those?
You request a Public Defender on your first court date and either plead not guilty or stand mute

You need legal representation. They will assist you in possible defenses in your case. You will most likely attend a diversion class, pay fines and fees and have community service. I would go maybe even go to court a few days before your court date and sit in court to see how the proceedings go. Court is open to the public, so you can go in and sit and watch.

There was another question we were wondering:

Everyone says that yes that they can add me and my friend together- but if they did that wouldnt that be a misdemeanor first degree, instead of second (which is what it is listed as on the booking site) Are they able to change charges around? Or would it have to be what it is on the Police Report I was given?

and also something i forgot to add prior::
If they believe that my friend has stolen another time in the store when I was with him, prior to this, can that be brought into this, or is it just this, since they didnt actually catch him stealing/no proof and he walked out the door with no issues that day.

Its the DA (not Police) who file the charges

If they have no evidence or confessions of prior thefts its doubtful they will be added to current charges
