Ok, so to make it short, i got caught shoplifting yesterday. the stuff i took totaled to $92, so i know that it is not a felony. my friend and i put the items we wanted in our purses and attempted to walk out of the store, we were stopped and taken to an office where we were asked to empty our purses. they called the police and we were both arrested. we were taken to the jail and had our fingerprints and pictures taken, and then were let out. i dont know what to do now, i know that my court date is about a month away, but i dont know what exactly that means. do i need to get a lawyer? (my friend's mom is getting a lawyer for her). also, is there anyway to get this off of my record forever? i was planning on joining the navy, but now im not even sure if i could do that. please help me. answers are greatly appreciated.

Your facing criminal charges and criminal record YES! you need a lawyer! Many offer free consultations get as many as you can. When you meet with these Attorneys ask them about diversion

im so scared that i completely ruined my life. is there any truth in the stuff they say on the NASP website? would that really help, or would it just be a waste of money? i cant afford a lawyer, will an appointed lawyer really do their best to defend me?

I personally recommend the NASP program to shoplifters and some internal I come into contact with

ok, well i have looked into it, and it costs a lot of money. i dont have money for a lawyer and i dont really want to have to pay for this, especially, if the judge isnt even going to look at it...

Who says Judge wont look at it? The cost is far less than the fine you will getting but its your choice.

so, im convinced, and will have to find the money to complete the course. i looked up information on adjournment in contemplation of dismissal, i was wondering if this would be possible for me. there was a part of the article i read that i did not understand. it said " If evidence demonstrating guilt is not presented, the matter is deemed dismissed, and the ACD proceeds along its standard course of action."

ACD or Diversion programs vary its best you talk to a local Attorney on this. If I was to sum up the "norm" it works like a conviction with fines, community service, possible classes, probation etc. However once you successfully complete program your case is dismissed. This means no criminal record.

i have another questions, what can a security guard legally do in the state of illinois? i read that they can detain you until police arrive. i am asking because when the security guard stopped me i asked if i could call my dad because i wasnt sure if i should be answering his questions and he responded "you have no rights now, and if you get out your cell phone i will take it from you." and then waved hand cuffs in our faces to scare us. is this right? do i really have no rights?

just for clarification, i had not been arrested yet, and had not been read my rights (right to be silent, etc.). this was right inside the doors of the store where he stopped me.

i would really appreciate any answers anyone has. thanks.

The store has every right to detain/arrest anyone suspected of theft. furthermore your "miranda rights" apply to Police questioning not store security. You still, of course, have the right to remain silent

ok, well my mom seems to think that he cant tell me that i dont have any rights anymore. im wanting to know because if he did something wrong maybe they will drop the fine i am supposed to pay them.
