So, me and my sister got caught shoplifting from Smith's about 6months ago. It was about $10 worth of food. The LP took use to the back and had us sign papers but our pictures weren't taken and the cops weren't call, nor did we have to pay any fines or receive any papers in the mail. Our mom picked us up, as I was 17 and she was 18(almost 19). I'm now 18 and I want to know if I can go to the Smith's and food4less stores now, I don't know how long we were banned. But can they do anything if I go there, even though they don't have a picture, ssn, or finger prints? And he gave us an example of what would happen if we trespassed (His ex. If you get in a car acciddent and the cops look up your info, you'll be arrested.) But how would they know that that's actually me?

If you return and the store LP recognize you or in anyway discover you violated the ban they have several options.

. Throw you out
. Arrest you for trespassing
. Arrest you for trespassing and file the theft charges they did not file at time (2 charges now)

But how can he prove it was me before, since he doesn't have anything that can say for sure that it was me before. Otherwise, he could press charges on anyone.

Yes they do. they have the report they filed when you were caught and any evidence they likely saved at that time. I have done this for a long time now trust me even if they did not file a criminal complaint there is a record of this event. If you want to return to store contact the Store Manager and request lift of ban. It is not in your best interest to risk arrest or embarassment to return to store.

Why stress over nothing. Stay away from their store. There are other stores, aren't there?

The paper you signed as a juvenile doesn't mean crap. If you go back to the store and are recognized they will have to give you new notice to stay out of the store.
