I am helping a friend figure out how to approach the decision made by the CFI in her case. I will keep this short.
*CFI was originally completed and submitted to the court with an adverse recommendation against the husband
*The husband was able to somehow able to convince the CFI to revise his decision so the adverse recommendation was removed
*This action was done without the knowledge of the wife
*The judge in this matter didn't question the CFI in there sudden and very drastic reversal in the decision
*The judge did not permit the objections to be raised by the wife
*She feels there has been a violation of the CFI professionalism and objectivity by allowing the husband to re-engage the CFI after the investigation was completed and a decision and recommendation was already made and presented to the court.
Does anyone have any advise on this point? I think that in order for a CFI to remain objective the CFI gives both parties the same level of access and consideration and then makes a decision after both parties have put their best foot forward. If the other party is not happy with the decision they should not be given another opportunity unless the judge allows it and the process starts all over agan for both parties. To allow one party to try and paint a better picture of themselves without permission of the court should not be allowed. This may not be ex parte but pretty close.
