Changing custody jurisdiction

My girlfriend is in a custody battle with her ex boyfriend. The baby is 7 months old born in New Jersey and lived in New Jersey all but 5 weeks in between. Since the boyfriend has filed emergency custody and numerous motions in Pennsylvania. Now weve been fighting this battle in Pennsylvania. My question is shouldnt we get the proceedings moved to New Jersey and doesnt New Jersey have jurisdiction over the baby? Isnt New Jersey his home state?
 
She should file a petition for custody in NJ to establish jurisdiction. NJ is the proper jurisdiction so it shouldn't be much of a problem.

I believe she may even be able to file for a change of venue through the court in PA as well. Filing for custody in NJ is still the smartest thing to do ASAP.
 
Hold it, MG - by fighting petitions in PA, she may have voluntarily allowed to PA having jurisdiction.

This is a VERY sneaky move by some parents, but not uncommon.

She NEEDS an attorney frankly.

(And let's not confuse change of venue with change of jurisdiction - just in case the two are being used interchangeably :) )
