I had purchased furniture on credit at a local furniture store 18 months ago. I purchased on 3 separate occasions within 3 weeks. The first was a 90 days same as, and I paid it off immediately. The second was a 90 day same as and I made the first payment on it. The third was a large furniture purchase (for me anyway) and have paid on it on time ever month since then. I found out I had to move from SC where i bought the furniture to WA state where i live now so I went to the store I purchased the furniture at and told them that money would be tight for a couple of months and made arrangements with the finance manager of the store to make $100/month payments until it was paid off. I did this religiously. I got down to $200 left on the account (the other acct never being late) and the corporate office for this company put a charge off on my credit report. I made the verbal agreement with the store, but they are saying that they dont care, i financed for 90 days and they have the legal right to charge it off. They will not honor the agreement the local finance manager made with me and he has not been able to get them to change it either. I have also talked to the store manager and the owner of that store and they all allowed me to make those finance arrangements.
That said, what legal recourse do I have to get this charge off OFF my credit report? Can I sue them for breech of contract and for wrongfully blackmarking my credit? You would think with two other account paid on time and in full they would not have been like this. Any help would be greatly appreciated.
