Good day. My last payment was around 05-1997. I decided to voluntary turn the vehicle back to Ford as it was a lease. I was still obligated for a balance of apparently $13,735 per a letter by FORD on 6-1997. I never acted on the letter or request. The vehicle was sold at auction bringing the balance down to $6500.00 FORD charged-off that balance in 08-1997

I had only a few conversations with Ford. I offered them $1500 on the balance of $6500 to close the charge-off and remove from my credit, it was never accepted.

I never worked with any credit collections even though I received many of letters. More than 6-years has passed an I just received a law suit for the balance of $6500 plus legal fees. My credit reports reflect "charge-off on 8-1997," I think I can use this as proff that state of limitations have passed. If I'm correct, SOL is 4 years in CA (Were I leased the car) and 6-years in Las Vegas were I now reside for sign document / contract. Can I defend myself with my proof and documentation that "Statue of Limitations" has run out on this matter?

Thanks.

It's worth trying. Note that you have the burden of proving your statute of limitations defense.
