I recently just came out of Chapter 7. I also had a CH.13 but it was dismissed and my car creditor is asking for all past due monies which total over $6k. They gave me 8 hrs to come up with the money. I was unable to and they tried to come get the car. I told them it was out of state(which it is). They called today and said they wanted to know where the car was. I told them it would be back on Jan.7th. They said that was unacceptable and they would be charging off the vehicle. I spoke with my attorney and he assures me that we won't be held liable for any monies due to the Ch.7. What I want to know is, is it illegal for me to not give them back the car when they want it or not at all for that matter?

Ask your lawyer.

Normally you either agree to surrender the car as part of the bankruptcy, or you keep the car and make the payments. It sounds like you tried to keep the car but didn't live up to your obligations, in which case you'll have to give it back.
