check from credit card company

Eight months ago I got a new credit card and put it in my safe to use later on a trip. Before I could use it,someone fraudulantly charged $3100 to my account.I contacted the credit card company. They sent me fraud papers that I filled out and sent back. I then received a statement showing that they removed the $3100 charge and a balance of 0. About a month or two later I received a statement showing a credit of $3100 instead.I waited about four months to see if they would catch their mistake, but they didn't. So, I called them and told them of the mistake. They told me not to worry about it,that it would be taken care of. But, about 10 days ago I received a check for $3100 and a note saying that this is a refund of a credit I had. I put it in my savings account for now. I would like to know what my legal rights are with the money since it was their mistake,I called to correct the mistake,they had over six months to correct the mistake,and they still sent me the check? Is the check legally mine now? Can I get in trouble for keeping it? and what are my options if they do catch their mistake?
 
You have no rights to keep that money. Write them a letter and attach a check for $3,100 plus copies of the fraud papers that they sent you and state on the letter that a mistake was made on their part. Send the letter certified so you have proof that you corrected their mistake in the event they decide to come after you in the future for any reason. Good luck!
