my grandson was placed in my home by child and youth services due to a fractured elbow that was unexplained by his mother, my son was in prison at the time so i stepped up and took him in my home, child and youth has ruled the inciden accidental..the local police dept has told me the investigation is not closed. cys told the mother after 30 days of her being in one place (yeah right) she can have my grandson back, she plans on taking him out of state for a week, which i am afraid she wont be back and we have a custody hearing on march 20th. she want sto go to florida the 2nd week of march. if cys places him back with her, can i legally prevent her from taking him oout of state before the custody hearing? going crazy with worry....can anyone help and answer this question?

You should immediately discuss your concerns with the police and CYS.

If the mother is to be charged criminally, that will usually be done by the police agency.

CYS primarily oversees the safety and placement of children.

You need to inform both agencies (police and CYS) what this woman is planning.

I suspect she's going on the lam to parts unknown.

Once the police get wind of her smelly plans and CYS hears what you know, I'm betting things will be sped up, or the child will be left in your care.

I would not allow her to have the child, unless and until, she produces a valid court order!

If CYS places the child back with Mom, Grandma/pa CANNOT withhold the child from Mom - custody hearing or no custody hearing.

Doing so would jeopardize any change the grandparent has of getting custody.
