My sister died a little over two years ago and her husband 6 months later started dating my sister and mine's cousin, well the cousin decided after I found out about an incident where she abused the youngest that she didnt want me to be appart of their lives anymore and their father let her. So I havent seen them for a year and a half. But after the cousin and father refused me visitations with the children I went to Child Protective services with photographic evidence that they were being abused. A year and a half later. This hits the news. wouldnt let me post the link yet but blieve me it's not good. The father is in jail for felony child abuse with harm. I just want my nephews with me. But here is the problem. Hubby makes 95k 3 BD home everything is waiting for the chidlren but, I resigned the rights to 2 of my chidlren in 2004.
I never made any mistakes through my case it come down to my income not being sufficient enough to be the head of the household. So..... Please help me.

Do you mean that you gave up primary custody of 2 of your children, or you gave up your parental rights? If parental rights, what were the circumstances?

I resigned my primary rights at the demand of the court but I do have great news thats gonna help sooo much. The foster mother and I are very close and she works at the school where my nephews went so she cares greatly and she informed me earlier that she is willing to stand up for my husband and myself and will verify that my life has been very different for a long time. But the facts surrounding my case were I resigned primary to the foster parents. With the agreement that I would always have visitations with the children. There really were no mistakes in my case. It all boiled down to my income at the time. But my husband makes 95k a year. We can take those kids away from all of the yuck that they have been exposed to. Honestly I reported these people for child abuse a year and a half ago... I failed them then by not being able to come up with enough evidence for child protective services to remove them from the home. One of them had to get hurt. But hopefully with the Foster mother standing up in court for me.. they will see that I am very fit. But I am still afraid. Failure is not an option.

Yes. I was a cashier at wal mart at the time. And His exact words.. Believe me I remember them well were. Your income is not sufficient enough to be the head of your household and I see no reason to put the children in your home when we all know that you will either require assitance from the state with the bills which you will be denied because of your income or you will have a shut off notice for one of your major utilities and we will be right back here for negligence.

Where were the children before that court date? Had they been removed from your home, or did someone else have custody?

No they hadnt been removed from my home. I had left them with their aunt (not my sister) the fathers and she and her husband got into a fight and the police were called and every child in the house was removed. Inlcuding mine. They said it was negligence on my part for leaving the children with the couple. The had a past of domestics that I was unaware of. Father's family. He never made me aware which was brought out later in court and blew him out of the water for trying to get the kids.

Well. The ball is rolling. Everyone has been made aware of my past and of my intention's. I have a meeting with the lawyer who represented me in mmy court case in 2004 Tuesday. And the foster mother who has my children has agreed to stand up in court for me. So now we just have to go through the motions' MTD"s and what not. My question is though. How can I find out if there are any other instances somewhere where the aunt get's the children from the father due to extinuating circummstances?
