child custody modification

My ex husband received custody of our two children. Due to me being unable to care for the children at the time. I have full filled all requirements ordered by social services and the court. I have maintained a strong connection with my children despite the 5 hours distance between us. I have been clean and sober 6 years now and have completely turned my life into a positive, productive, and healthy balance that I am so proud of. A year and a half ago my ex husband moved the children from year round school to traditional, my visitations have now been cut down to minimal. I went from having them every 9 weeks for 3 weeks to hardly seeing them now. This past Christmas vacation he out right refused me visitation with them, and since I requested to have them for their summer vacation he has informed me I can not have them the first week of july. Which breaks our time up. He has out right refused all court ordered stipulations in our court order. My question is, would it be mistake to take him back to court without a lawyer? It is past time to have the order majorly modified, however I am not only paying child support but also covering his mandated order to have the children covered with health insurance. I also have another child at home with me. I just don't have the extra money.
 
The court always looks at what's best for the children.

What's best for mommy or daddy doesn't matter.

Uprooting those babies is not going to happen, because that's not what's best for the children.

Trying to seek a modification without an attorney is also foolish.

By the way, one year, five years passing doesn't mean the order will be modified.
 
What does your current order say with regard to visitation? If it is no longer feasible, or you want to modify it, you can do so through the court. You may not get exactly what you ask for, such as the entire summer, but the order should reflect the altered school schedule. I would never recommend going into court without a lawyer. your kids are worth the cost.

Your best bet is to talk to a lawyer. For a no cost/low cost lawyer - you can check with your local or state bar assoc. or local legal aid society for a referral or a local law school if their is one. Good luck.
