My wife left me while we lived in colorado. I moved back to Washington state to start over. A few months later she supposedly filed for divorce, but I have not recieved anything. She then moved to texas. I am unemployed and my wife still works for my former employer. My wife has several different documented conditions mental and physical which she is prescribed all kinds of things from pain pills to anti-psychotics. What are my chances of getting custody of my two children ages 7 and 5.

The bar is set very low for motherhood. She working and, as long as she can show that her meds are keeping her mental issues under control then her mental issues will have no bearing on custody.

You can call the county courts where you lived in CO or where she lives in TX and see if a divorce case has been opened.

If it has, get a copy of the case file so you can figure out what's happening.

If it hasn't you have the option of filing for divorce in WA once you have met the residency requirements. WA apparently doesn't have a specific duration of residency but it does have a 90 day waiting period after you file and serve your divorce petition.

You can seek custody if you want but I suspect that the best you can hope for is visitation.

Until you're LEGALLY divorced, your parental rights are equal to her maternal rights.

If you want custody, you start by filing for divorce and custody.

Hire yourself a lawyer, file for divorce, and if you're smarter than she is you file or divorce in TEXAS.

Or, you could file in Washington.

But, first you visit a lawyer and ask your questions, then decide how best to proceed.

Last thing, because she ALLEGEDLY ABANDONED YOU, we'll ask that lawyer. He r she can SPLAIN it to you, even the part about getting her to pay for the divorce.
