Child support from father in jail

My estranged husband has been charged with 304 counts of child pornography and will most likely go to jail. He may be charged with child molestation if my daughter will tlk to a forensic interviewer. I've been told that in our parish it is required. Is there any type of support for my daughter? Since he won't be able to hold a job while in prison can any assets he has be liquidated in order to meet his support obligations? What rights does my daughter have?

You cannot do much with him in prison. Be thankful he is caught and that your daughter is now safe. You should be filing for divorce and see about terminating his rights. If he is convicted of crimes against children I would be more concerned about protecting her in the future than child support. He will make almost no income in prison. A child support order will most likely not be made since is jailed an has no income. You need to talk to an attorney. I suppose you may be able to ge your equitable distribution in a divorce.
 
A child support order is already in place. And my first priority is absolutely my daughter. She is physically safe now. We shall see what the future brings to her mentallly. He hasn't been convicted yet only charged. This has been going on since May of 2007. I just started receiving support this month because I agreed to have him pay our house note in lieu of child and spousal support. Our home is for sale. He still resides there. My question is if he can be made to forfeit his profits from the sale of the home or to sell things like his motorbike or boat etc., to meet his support obligations especially since an order is already in place.
