I've asked this question before, but got no response. I'll try this again.
Is it unheard of to carry life insurance on an ex husband to cover the arreared child support that he owes? Do I have to get the policy or can he be forced to carry a policy? Can any life insurance he has at work be taken to cover what he owes our son, in the event of his death? Can anyone tell me what to do to make sure my son gets what's owed to him if this man dies before he pays back the $35000 he owes? I appreciate ANY help you can offer.

I've never heard of this, and I would guess no one else has since you haven't gotten a reply. Generally, child support obligation ends with the NCP's death, but I don't know why you can't take out an insurance policy on him yourself. I doubt that the court would require it, though.

As for the arrearages, you could call your CSE to see how the arrearages are handled in probate and what you can do to protect yourself.

Yuo might be able to go after his estate if he leaves one. You will also qualify for SS survivors benefits if the child is a minor. He probably cannot be forced to get a policy, but I do not see why you cannot carry one but he will have to cooperate with a medical exam if one is required.

Thank you for taking time to ponder my question. I called my insurance company today and asked them about this. They tell me that he will definitely have to sign the papers making me or our son the beneficiary. Unfortunately, our DHR will not divulge his location in TN, even though their attorneys are the ones that got the order for 17 years of back support. The order states that he and I are supposed to exchange information, but they didn't tell me how to do this legally. I just wanted you to know that your input is greatly appreciated.
