hi this is a good one and im hoping somebody can help me with it.....i used to live in ny state, i had children 3 to be exact....when the kids were 10 and 8 respectfully thier mother moved to kentucky and i paid support till they were 21 well my daughter my son who is 19 has been on his own and child support tells me the case is still active in ny even though this child has not been in ny for over 11 years. They tell me to go to where she lives and file a modification....okay now for the other one, about 9 years ago the third child, his mother tells me her beau wants to adpot him and has me sign a paper giving her permisson to change his name, lo and behold she gives him the bf name and im still paying child support for the last 9 yrs...i cant find her, her current address she wont accept any certified letters and ny courts has declared these courts cases null and void saying they dont have jurisdication in these cases , yet child support tells me to pay support...okay im open for suggestions, in all this im hoping somebody can help...thanks

I'm not really clear on what is happening here, but you need to get the original judgment in the first lawsuit modified.

It seems like NY still has jurisdiction. If you want jurisdiction moved over to moms new state you have to file for it and NY would habe to release jurisdiction.

As far as the childs name, well, you should not have let mom change the childs last name. It does not mean the child was adopted so you still owe support on that child. It does not sound like your rights were terminated, but why would you allow him to adopt unless you decide you no longer want to be the childs dad?

You need to see an attorney in NY since the case is still open there and see about releasing jurisdiction to your state, or moms.

She could just be refusing certified letters but lives there. When you say 19 yr old lives on his own, is he really on his own or in college? The kids will know where she is if she is not at the last adrress you had...ask them. You don't know if the last child was adopted or not? What did the name change papers say the reason they were for? I am not sure if adoptions are public records but if they are you can find out one way or another and if she continued to get your money after the adoption if one took place, you may be able to get it back.
