I live in Massachusetts and I am trying to collect back support from my ex-husband . Due to his own fault he lost his drivers license a year ago. (He was arrested for drinking and driving, his second offense and lost his license for three years, he also lost his job that he was at for 20 years, a drivers license was required for his job). He requested a reduction in child support of 100.00 per week and received it. He has not made a child support payment since Feb. of 2008 and owes me 5000.00 dollars. The DOR (Department of Revenue) is tracking his history and have taken all actions allowed by state to collect back support. We are now waiting for a court date for contempt charges. I would like to have my original child support amount reinstated. I gave him a partial buy out of our marital home and depended on that child support. Now I struggle to make my monthly bills. What do you think the chances of me getting my original support payments reinstated?
I have taken my ex back to court on my own for contempt charges in the past, should I wait for a DOR court date, it can take several months or go it alone?
Thanks for all your help.

Hire a lawyer and go after him.

He does have money, doesn't he?

If not, you are wasting your time.

Still, it would not be a bad idea to get a judgment in your lawsuit. You never know, he may have money or property one of these days.

In order to get the original amount you need to prove he is making that amount, also jurisdictions only allow a review every 2 or 3 years, unless you have a change of circumstance.
