Child Support Modifcation

Good Day,

I have been paying child support for sometime now. The mother of my child is quite volitol in our meeting held in the court. She has managed to work the support payments up to the state maxinum, even the most recent case worker asked her at one of the last meeting how she managed to do so since I was unfortunately unempolyeed off and on for a few years.

I am now employeed full time and also cover the childs medical and dental benefits. Becasue I fell behind for those few years the state now takes the maximum 50% of my pay which in turn leaves me very little to live on and support my family. I am now in a position to file for a modification and was wondering if you had any advise of the best way to go about this.

I read that I will need to know her income and then she will be served before a court date is set. How do I obtain her income level, or can the courts do that? And what happens to her is she simply doesn't show up to court?

Also, the mother doesn't allow me visitation with my child (not on the books of course) but states "You don't pay me my $$ so why should you get to see her!"

Please help, any advise would be the most appreciated!!!

Laws vary from state to state so please provide your for accurate answers.

But in no state is a parent legal obligated to provide visitation without a court order. It's craptastic parenting...but not illegal. Depending on the relationship you have with your child she could get a sever wrist slap for the Judge for pulling this...Which of course would be on record for future problems.
 
Is there no court ordered visitation schedule? If not then get one. Not sure if you qualify for a reduction or not, not sure what the state mnaximum is for garnishments in your state. You really need to call around for an attorney or maybe contact some fathers rights groups in your state for help. You should be able to see the child
