Child Support Question

In my settlement agreement, my husband is court ordered to pay me $1200 a month in child support. As of today, my ex-husband was granted temporary custody of our 3 year old through a police department, not Riverside County Court, due to him fabricating statements that I have made.

So my question is this....with him having "temporary custody" via the p.d., with no court order saying otherwise, does he have to continue to pay me child support?

Also, I have been told today that he is now going to fight me for full custody of our daughter. We have had joint legal custody since we separated and divorced. How does a father get full custody?

Any information or advice you have is greatly appreciated.

Generally, yes, he has to continue to pay until the order is changed. However, he may file for child support since he now has the child, and he may also ask that the order be retroactive to when he assumed custody. There is no guarantee that he will get that, but it's a possibility.

He gets full custody, and changes the current custody order, by proving that it is in the child's best interests to do so.
 
He gets custody if the courts determine the child is better with him. You say he has fabricated some of this. They normally jsut do not remove kids out of your case unless there was some evidence something is going on. What is going on in your house? If he gets custody you'll be paying him child support.
