Childcare pay

My girlfriend I hired a lady to watch our son. I was never really fond of her. She has an expired license that is two years up on the wall along with other little things that bother me. We already paid her for the month to watch our son. The other day my girlfriend came home and said "we are done with that daycare" the lady that watches our son had a ton of complaints about our him. She complained she was getting headaches and never gets headaches, along with how the other kids were not getting sleep. She claims our son won't go to sleep and just fusses the whole time. She said if it doesn't work out that she will have to give us two weeks notice. This of course is frustrating on many different levels, especially when she talks about my child like that. He is a very good kid and we don't have these problems. He is the youngest at the daycare and has only been going there for a few weeks. I'am not comfortable taking back to this lady at all from what I heard. I was wondering even though my girlfriend signed a contract I have not seen, can i get my money back for the rest of the month? Is there some sort of course action I can take for not just us but other parents. She was very, very unprofessional about this whole situation and to me if you will say that to a parent, who knows what she is saying to kids who are giving her head aches. help!

If she had an expired license & you really weren't fond of her, the best thing to have done was not have left your son with her.

You need to read the contract signed. You may not be able to get out of it with a refund of any money paid. If she gives you notice to remove your son from her care, she should refund any time you paid for after the removal but read your contract.

Your recourse appears to be sorting this out with your girlfriend. She signed the contract, so if you didn't sign anything you don't even have standing to object at this point.

Be VERY careful about what you say to others about this - the last thing you want is to be on the wrong end of a defamation suit.
