choosing a guardian

My question is can I appoint a foreigner as a legal guardian to my minor kids in the event of my death?

Where is Dad? Not sure what you mean by foreigner, why would you want to appoint someone other than family or their father? You cannot "Will" a child, so actually the answer is no but you can certainly let your wishes known. In the event of your death though, the father or next closest relative can petition for custody.
