christmas ruined

my boyfriend was in a traffic jam and was rear ended. all the presents in the trunk are ruined. he got a ticket in the emergency room....the police report said he was stopped looking at an accident...hes 40 yrs old why would he do that? the 18 year old in the car that rear ended him said that. his buddy another 18 yr old was a witness. my boyfriend wants to fight this...he was stopped on the highway because it was a traffic jam..we've all been in them. i dont understand how these little ******* in daddy's jeep can get away with lying.. how do you get a ticket when you are the one rear ended?
 
In what state did this occur, and what code section was he cited for?

I'm surprised he was cited for the accident as it is usually the rear-ending vehicle that gets cited or is listed as the party most at fault.

He may have to hire an attorney to help mitigate the damage. Because, the police report having him at fault is likely to play against him with regards to the insurance matters as well. he needs to pursue vindication for the citation if he can.

He should consider consulting an attorney as soon as he can.

thanks he has contacted a lawyer now, it happened in ohio, the cop took the kids statement but not my boyfriends at the accident, he gave him a ticket for being stopped on the highway or something.....His car didnt have front end damage because he was stopped 3 car lengths behind the stopped vehicles letting people get over in the left lane in front of him because there was an accident on the right hand side of the road....if he had been right up against the car in front of him i dont think this would be an issue....
 
Even stopped so far back, the vehicle following behind should have been traveling at a speed and distance back that offered him sufficient space to brake or maneuver. Unless your boyfriend was stopped around a curve or in some obstructed location, I don't see how he was considered at fault.

But, perhaps Ohio has a different practice when it comes to assigning fault for collisions.

In any event, a civil court and the insurance companies are not bound by the police report and may assign fault on their own.
