chronically paying rent late

I have a tenant in Rockland County, in a 2 unit home. Lease is only since July 15, 2009. Rent due on 1st of each month. Paid late in August, and has still not paid for September. First said will have on 15th, then 16th, now will have it on Friday 18th. I obviously will have a problem each month, and I can'tafford it. I would like to end the lease. Do I accept their rent this Friday (if in fact they have it) and then still be able to evict? How do I proceed?

Eviction may not be needed. Yes yo can accept rent but you can also give them a "notice to vacate". They breached lease with late or non payments. Now if rent is not paid then yes evict
