I received a citation for non-payment of a credit card in the amount of $2068.71. I defaulted on the card in July of 2007 so the statute of limitations do not apply. However, if I do not respond to this citation, in the state of Texas, what can happen? Also, what happens if the citation is not dated as to when it was served?

If you don't respond, they'll get default judgment against you, and will proceed to collect on it. Garnishment, liens, etc.

Not being dated is probably a technicality. It doesn't sound like there is any doubt you WERE served. But you never know. It might have some relevance if you file your reply late.

burden of proof

Ok then, if I use the defense that I have no business relationship with the Plaintiff considering they are a collection agency, can I still request validation of the debt? I have read that requesting validation of the debt is helpful, but it seems contradictory to request the validation and then declare that there is no relationship.
