Citation for selling cigarettes to underage person

My friend's 17 year old son was working at K-Mart. He sold cigarettes to someone under 18 without asking for ID, it was a sting. He was issued a citation. He's freaking out because he's not even had a traffic ticket.

It's a misdemeanor, what I read says the max penalty is $1000 and/or a year in jail.

Any idea what to expect?
 
How old is your son and what state are you posting from?
 
Do you know if the friend's son was trained by Kmart in having to ask for an ID for selling tobacco? That may be a factor in his favor if they did not train him properly. What action did Kmart take towards him? It may be worth seeing a lawyer for a consultation to ensure he is represented properly. Often, there is a fine and some type of community service or program he will have to attend or even lose his driver's license and be aware New Mexico is taking selling tobacoo to minors seriously so he may want (need) the lawyer consultation.
