Hi,

I got cited by CHP for driving at 56 m/hr on a 55 mile zone. The officer acknowledged that I've a clean record, but insisted on writing the ticket. I've decided to opt for Trial by written declaration. Just confused on what to include. Should I plead not guilty citing that i was merely a mile above the limit ? I guess, in that way, I'm kind of accepting that I was at fault. It was around 8 pm at night and I was coming down on a 4% grade.

I'll really appreciate if someone can provide pointers on the best approach. I'm really trying to avoid paying $234 and losing bunch of traffic points on this.

-Thanks

There is more to this. I suspect the officer observed you at higher speed in the process of slowing.
If you challenge this in court do not admit guilt. 56 is still over the limit.
You could also take a traffic school class but would have to pay fees.
