my account has been past due on a credit card. The credit card company turned it over to a law firm. They responded by issuing me a judicial summons. I tried to work out a payment plan of $500. a month (the amount owed is under $3,000.00 but they wanted the amount in full and gave me 10 days to pay it). I dont know what to do next or what forms I need to fill out. I know I have 30 days to respond, but nobody will tell me what I should be doing or how I should respond to this ( I live in Orange County, CA). :(
 
I am sure it's a small claims case........Go to the web site of your local court and see if you can download the forms to respond. File the response with that offer to pay the $500.00 per month. If they wont agree I am willing to bet the judge will make them agree.
 
if it's a law firm, it's not small claims. it would be a limited civil case (at least in CA) file an answer and go to adr, agree to a stipulation (in lieu of judgment) of $500/month. if you default, they can and will get a judgment against you.
