we received a civil summons, from a family member stating that we owe a substantial amount of money. Two years ago they purchased a mobile home for us as a gift. Now they claim we owe them for the mobile home in full, and there was never any agreement written or otherwise stating anything about a re-payment. He is attempting to put a lien on our home will that be possible? We have thirty days to respond to the summons, but what steps would he have to take to file a lien?

How can they claim that they own the mobile home? Who is the registered owner? Remember that the plaintiff must prove his case that the home, which you've had for the past two years without any evidence that it was anything other than a gift, was in fact a loan. I assume there were no payments you made to them for the past two years.

You should respond to the summons. If I were the judge, I'd like to know why the family member is now trying to sue you for the home. Why are they going after you? What is the source of the disagreement that we're not hearing about?

Mobile homes normally have a certificate of title. If the title has never been transferred, he still owns the home. If you want to keep it then you need to work something out.
