claim growing due to dept on credit card

I NEED HELP!!! I am in Cattaraugus county, NY I am owed money from a family member slightly in excess of the $3000 max, the real problem is that it is on a credit card and continues to grow. If I win my small claim for $3000, the max in this village, can i then at a later time sue for any additional money i paid out to make the min monthly payment? I do not feel it will be easy to recieve payment and will have to make monthly payment untill i collect. Also, if a couple is separated, still legally married, can a lawsuit be brought against the party i feel owes the debt?
 
You can bring a lawsuit against anyone you want. If the person is married then you can try to collect from the spouse as well.
If you are able to obtain a judgment in small claims then the judgment will accrue interest.

If when you say the amount continues to grow is actually because someone is still using the credit card then you simply need to deactivate the card.

Before going to court you should send a letter to the person that owns the debt requesting payment.
