Claiming child tax credit.

Heres the situation, Father has primary residential custody and the court order says the child gets to live there and he gets to claim the child every year. Problem is he doesnt want the child there and child has been living with mom 100% of the time for over a year. Child doesn't even visit with dad. Does mom get to claim the child now since dad is not following the order by letting the child live with him?
 
You are required to follow the court order. If you violate the order, you can be held in contempt.


If he is violating the order, notify the court via requesting a hearing. He could be held in contempt and you might get what you want. He appears to be violating the order.
 
Until the court order changes, Dad still gets to claim the child.

If Mom has had the child for a year without Dad even visiting, Mom should have the custody order changed...he's abandoned following it, so that's grounds for a new order, especially after 6 months.
