I trying to collect on my dads estate Ive been in prison for the last 6 years and my father past away in 2001 so after my release Ive been trying to collect from my older brother an in the process found out that he did not give anyone there share of the money after probate the money total 180,000.00 is this a criminal case are something that Iam going to have to sue for in civil court. also I would like to know which papers to file and also can his air force retirement check be garnished thanks for any help you can give

The court to sue in varies per state. I can't help you without that knowledge. Each court has a jurisdictional limit and you should search to see what courts are available in your state. After you win your case (especially if the criminal case results in a conviction) you may need to enforce the judgment if your brother doesn't pony up voluntarily.
