I co-signed an apartment lease for my son and his room-mate in September of last year. On the first page near the top it states that the lease is for seven months. On the back it states the lease is over on a date which would have amounted to a twelve month lease. When my sons room-mate needed to move out, they reviewed the lease and seeing the 7 month statement, proceded to do all the things required to end the lease,ie: 3o day notice, clean up and inspection , etc. as the lease called for. The land lord stated that we would have to pay the 2 month lease buy out as stated in the lease,and we were to ignore the 7 month statement on the lease. An attorney told us that such a discrepancy would void the lease and that we should not pay any further monies.
We later received a letter from the landlord claiming we owed 4 months rent because of early move out. We responded with certified letter stating our obligation had been met and expected our deposit to be returned as the apartment was returned in good condition and documented as such by his leasing agent. Today we received a call from a collection agency stating that they would make a report to a credit bureau if we did not pay the 4 months rent by 12/20/08. They stated that we could write a dispute, but the report would still go in with a "dispute" addendum.
I would certainly appreciate any advice for my next move.
