Collection agency coming after debt that I won judgment on

Hi,

In 2005 I was sued over an old credit card debt. I went to court and was given a Judgment on my behalf with prejudice against the company. It is now 2 years later and I received a letter from another collection agency. I called and told them I won a judgement and they told me too bad they purechased this debt and i owe it. What can I do to stop this.

There is very little you can do and this is very common. They just keep selling it from one agency to another, illegally reaging the debt and calling. Get an unlisted number or just don't answer when you know it is one of them, usually an 877 number. You can make up a letter disputing the debt and demanding validation. Every time you get something send it to them. Check your credit report and send in the judgment to the CRA if it shows up. They will take it off.

I think she needs to sue the collection agency.

Go see a lawyer who handles this kind of stuff.
 
With preduice means the company is barred from reopening the case forever. However, the debt can be sold to another party. Your position would be that you have no contract with the company that purchased the debt (for pennies on the dollar). If you have been served with complaint and summons you can file a motion to quash procedings. Contact a lawyer before it goes any further.
