Collection Problem-Check Promised-Not Sent

We own a business and recently installed a sign for a client. He lives out of state in Pa. He gave a deposit for the sign by credit card. He has been promising to send a check "tomorrow" for about a month now. Can we just charge this on his credit card since he fails to send the check?

No. You definitely do not want to do this. If you do so, you are doing it without his authorization and you will have problems. What you probably want to do is send him a certified letter about the overdue payment, the check that never gets sent, and a request to simply take care of it via his credit card and ask for his authorization to put it through.
