My daughter ran up a debt that was turned over to a collection agency while living at home. She has now moved out and is own her own. I got a real nasty call from the collection agency in question. Because they do not have her new address they basically sounded like they were telling me that I would get harrassed until the debt was paid. Seeing as how my name is not on the debt in question what are my legal rights here as a third party?

If you are not legally obligated to pay the debt and you have made it clear that the actual debtor no longer lives at your residence, then this company IS harassing you, and you have every right to threaten them with a lawsuit if you continue to be harassed. It sounds like it might be time to reverse the role and put the "fear" in them. ;)

Absolutely! If you have to, send them a fax stating that the debtor no longer lives at your residence and that the letter constitutes written notice. You may also want to state that you will prosecute them for harassment and that you know your rights under state and federal law! You might want to make reference to the Fair Debt Collection Practices Act. Good luck!:D
