My wife and I have both tried filing for bankruptcy the past year twice..... but, we exceed the criteria for doing so by about 1,200.00 dollars. We live in Michigan and we are currently in a court issue with citi-bank who wants a balance of 5,086.36. When we went to court the first time we offered them $500.00 down and a monthly payment of $75.00..... They declined! Citi-Bank stated they needed $1000.00 down for a $75.00 month pyment plan. So the proceedings went forth for a garnishment hearing coming up at the end of this month.

Today I called citi-banks representatives and offered them $1,000 down and $75 dollars a month..... they refused and said that was back in June... Now the monthly payment is going to have to be $180.00 a month. I told them we were strapped and could not afford this... She told me too bad that is all they can offer. I tried to get an explanation why the monthly amount jumped drastically. Now we are heading for garnishment which is going to ruin everything we have accomplished to stay on top of our bills. I mean we have made cuts everywhere to make ends meat and pay all our other creditors and now we are down to the last one and they are going to make in impossible for us to pay back our debt honestly. What advice can you give?
 
I am no expert but I think you need to be persistant here. I would stay calm and ask how you can come to an ageement that suits both of you. Try and appeal to their compassionate side and explain in detail why you are in the position you are in and what you can afford. Sell your self to them and be honest lets face it you are not the only one that is in this position and the bank will want their money back with the least amount of difficulty. It sounds like they are negotiating with you and think you are going to break because you already did once. They may think you are playing them. So again my advice is to write everything down and either call them, visit them or send in the letter. The best would be to visit them ask to speak to the bank manager don't settle for less.

Be Calm these are hard times and citi bank are struggling just like everyone be sure you detail everything and face this head on.
