I owe a loan company and didn't make three months of payments. I called the loan company as soon as I was able to pay the loan. They took $2500 from me before they told me that I was being sued. I was told to call their lawyer. When I did I was told that if I wanted to settle that I should send in a proposed settlement letter. I did. (Mind you I never received the law suit paper until two weeks after I spoke to the loan company.) Never heard from them since. I finally got in contact with the lawyer's office a week before the court date and was told that the loan company would not settle for the principle and interest that I owed. They also wanted court cost and attorney fees. The difference would have only been about $800. They said that if I signed their settlement letter (which took them three weeks to send.) I wouldn't have to go to court and would not have a judgement against me. I don't know if it this is in my best interest to sign or got to court. This ordeal already reduced my credit score severly. Please advise....
 
Have they shown you good faith?
Have they lied to you?
Have they tricked you?
Did they surreptitiously purloin $2,500 from you?
Why would you TRUST them after all they've done to you?
They've lied to you and deceived you.
They've committed felonious trickeration against you and your assets!
I'd go to court.
The lawyer won't get paid, unless you agree to pay his "fees" (God only knows what they'll be).
Going to court won't hurt you financially any more than agreeing to pay their demands for tribute!!!

I'd only pay them another dime, if they beat me in court.
Who knows, if you're smart, do your trial preparation (or pay a good lawyer); you just might beat them!!!



By the way, even if they beat you in court; their next problem will be enforcing their judgment.

That isn't easy if you're smart.

They could just be left with a piece of paper!
