I live in Indiana, my ex-husband lives in California and we got divorced in Nevada. My daughter is about to graduate high school so I need to get a college modification so my ex-husband will be required to provide support for college related fees.

Which state do I apply in? thanks for any help.

IF the modification were to be granted, it would be in the state in which you were divorced.

In this case, Nevada.

Your husband, now lives in California.

The Nevada court no longer has jurisdiction over him.

You, no longer live in Nevada, so in order to bring such a claim, you'd have to establish Nevada residency.

Even if you were to bring your claim in an Indiana court, jurisdiction over a California resident would be hard to establish.

You'd have to serve him in Indiana.

Despite all of the what-if we could continue to do, you have no LEGAL basis for modifying the judgment.

That ship sailed when you got your divorce.

This is never going to happen.

Why not have your daughter try to appeal to her father, and you stay out of it?

Tact and diplomacy are always better than force and demand.
 
If college was not awarded in the orig order you have a very small chance of getting it.

You are going to have to have NV release jurisdiction but if they hold on to it, you have virtually no chance of getting college support. Same with CA. IN MIGHT give you some college support but they need to habe jurisdiction and Dad can certainly fight it and not pay. College support is awarded very rarely. Child support generally ends at 18 or graduation of high school.
