Hi, I need some legal advise.

I am currently on bail for common assault regarding my ex girlfriend, We had an argument one night and our neighbour called the police, I had told my ex girlfriend I wanted to end the relationship and she became hysterical and started claiming I had punched her in the face.

I was arrested for this and sought legal advice from a duty solicitor, I advised that I did not believe she would make a statement once she had calmed down and believed everything had been blown out of proportion, so my solicitors advice was to go "no comment" and hope she did not make a statement. It turns out she decided not to make a statement and the charges were later dropped. We had another big verbal argument a few days later and she said she was going to make a statement against me, which she did.

So the following morning I was arrested again and taken to interview following new evidence (statement, pictures e.t.c) I sought legal advice again off the same duty solicitor who this time said to give my account of what happened, I admitted to grabbing her by the arms and pushing her to the sofa to get her out of my way so I could leave the apartment, I denied punching her in the face and putting my hand round her throat. I was later bailed for this and I am currently waiting to hear the result, I know the police will be contacting the CPS on the 19th and I am due back on the 20th.

My solicitor had previously advised me that if I agreed to her statement, the chances are I would get a police caution but as I did not fully agree with her statement I did not do this. After sleeping on it I have realised that although I do not entirely agree with her statement I can live with a police caution and would rather just put this to rest and wash my hands of her, so I have since contacted the arresting officer and (metaphorically) discussed changing my statement, he advised he would put in a high recommendation for a police caution if I did this, which i'm not quite sure if I believe.

My other option is to sit it out and see if i get charged or if the charges get dropped for lack of evidence. The evidence they have is her statement, pictures of bruising to her eye (which I did not give her) bruising to her arms (which I probably did give her) and bruising to her leg (which i'm confused about) and also a statement from the neighbor saying he heard female screaming and male shouting.

I'm really not sure what to do here, I don't want to be charged so I am seriously considering agreeing with her statement and hoping for a caution, she is quite unstable though and has acted like this before so maybe I could fight it. I have previous for drink driving about seven years ago but I have never been arrested for any violent crimes. I know I should probably seek professional legal advise but I do not have the time or money for this, I'm really stuck on what to do here and would appreciate any advice.

Thanks
