Company claims they're NOT responsible for my theft while in their possession

November 30th 2009, I rode an Amtrak train back to New York from North Carolina. I checked 2 bags. One bag arrived in New York and was quickly found in baggage claim. The other bag only went as far as New Jersey and was put on a train to New York upon discovery. When I received the missing bag, my brand new $300 camera and warranty had been stolen. I did not realize this until I got home. I returned to file a claim about a week later (I am a student so I could not get back to the station as promptly as I hoped and I made numerous calls to attempt to make the claim over the phone).

After several phone calls, Amtrak representatives claimed they are NOT responsible for the theft of my camera despite it being in their possession and stolen by either one of THEIR customers or employees. They said things like cameras and laptops are not covered and they only would've refunded me up to $100 anyway. I don't recall ever being informed of this policy and even when looking to see if they covered it, I couldn't find this information neither printed on the brochure nor the website (perhaps it was my own oversight, but I never found it).

I did not put insurance on the camera because I didn't know if Amtrak had any and I've never had baggage issues with them before. I feel as though an employee stole it because that was the only person who was informed about the camera and would've been there to get the camera out of the bag before I returned to pick it up in the morning. I understand why they don't want to pay for it, but I have been a loyal customer and have no reason to lie about this theft, I even have a copy of the receipt that shows the camera was purchased only a couple days prior.

I don't want to have to take legal actions because, like I said, I am a student at NYU on a full scholarship and don't have much time to try for a case - I don't even know if I have a case. I need help because it's not fair for me to have to pay $300 for a camera I cannot use, it was for my photography class and has cost me more than I could afford. That's $300 of my scholarship money that is going down the drain, I cannot afford to replace it. What can I do?

But now is there anything that can be done at all considering that my bag got off in the wrong City/State?

And how can I secure my bag better for the next time? I didn't have a lock this time, but how can they tell if the lock is removed?

And why don't they state this stuff explicitly? I mean their employees didn't even know this policy which resulted in lots of wasted hours of my time. I mean, does none of that count for anything? (my wasted time - during finals, my missing property -albeit it prohibited, my lack of knowledge - b/c i couldn't find this link nor understand it at first, the employees' lack of knowledge - to avoid all this wasted time and money)

Is there ANYTHING I can do to get any sort of redemption? They failed to do their job in many ways, a service that I paid for. They sent my bag to the wrong place, had me waiting for hours to get information that no one knew about, i was told to fill out a form stating what was inside the bag and other personal information but was given no copy of it then my stuff gets stolen, and is there no disclosure policy?

Sorry, but there really is no action for you to take.
If you have a decent quality lock on your bags it is very unlikely that it will be removed without evidence of tampering. The problem here is having no lock at all.
I don't think the information regarding their policy is a hidden secret. After reading your post here I googled "Amtrak baggage" and the first listing took me to the page I linked above. Less than 30 seconds effort.
I understand that you feel like they have a duty to uphold regarding your service, but at the same time, you had a duty to protect your own property and did not. Had you secured your baggage and still lost property then Amtrak's insurance would cover you.
Many people have learned this lesson the hard way.

Amtrak isn't going to be liable for the camera, which is the big ticket item. At the most, you're out a few hours time for dealing with this. It's not worth fighting over, and you're unlikely to succeed.

Not sure what kind of disclosure policy you're looking for nor how this impacts your potential claim for the loss of your camera and time spent. And really, when you look at it, Amtrak's "failure to do their job" amounts to sending your bag to the wrong place. That's not what caused your loss - the camera being stolen caused your loss. And that's covered by Amtrak's loss waiver.
