Company dosent pay me says they can sue

I was working as an independent representative for a candy machine company. In doing so i was given boxes of candy and some company forms for use in my daily work. When the first month came to a close i filled out my paper work and deposited the money and sent in the forms. I then never received a paycheck so i have done no more work nor have i returned the items entrusted to me. They have now threatened to bring me up on charges i believed this to be a matter for small claims court. so i ask what should i do now. Thank you

What does your contract say you were supposed to have done with the samples? When were you to be paid? How does the contract provide it can be terminated? In absence of knowing these things, and maybe some other things, it is impossible to say what you should do. If it were me, I would advise the company they can either pay me or I'll see them in court, and I would be happy to return their items in exchange for them paying what they owe.
