Compensation Threshold

Here is the situation. Was called into office today and told that my new threshold in order to qualify for compensation was increased 10.5% for the current sales month. Is this legal/allowed? There are 5 selling days left in the current month and they want to force me to sign paperwork that I agree to the increase. I could understand if this was for the next month coming up but not for the current selling month. They have already projected my sales numbers for the month and it seems I will be below the new number.

Side note: i am an account manager with a set base of accounts. the last time a threshold change happened, it was because of an increase of accounts due to another employee leaving the company. This time, there has been no additional accounts added to manage nor any other significant increase of contractual revenue placed under my management.

other side note: if we do not hit our threshold we do not receive our "sales bonus" for the month.

I suggest you consult with an attorney in your area before signing anything.

It isn't illegal to ask you to sign.


It Isn't inappropriate for you to ask, "Why?"


Or you could say, if you're asked about signing the form again, "My attorney has taken your request under advisement. He's going to get back to me with an answer within 10 days."

And you could be fired in the meantime. If it's unenforceable, you have options.
