completing the job

about 7 months ago my husban signed a basic contract about how much and what was to be done. our sidewalks have been marked by the bough to get replaced at this time we hired a subcontractor to remove and replace the old sidewalks and the steps leading up to our house. when the contract was signed in october of 07 we paid him 3/4 for the supplies and labor he said that was needed for the job. we did not hear from him until april 08 when we called him to get started on the sidewalk. at that time he showed up and took two weeks to dig out and remove the old sidewalks. now we have a big long hole between the road and our house. we also live by an elemetry school so the sidewalks are now unsafe and the childern who walk to school and us home owners. we have tried to contact him and even visted him at his home. this has not got him movaited to complete the job, even his helper shows up, but nothing from the contractor. we need this sidewalk completed before someone gets hurt and we have to pay fines related to the work not being done. i want to know if we have any legel ground to get our money back or push him to finish the sidewalkes as agreed. i have done rearch about a demand note, but would like more info to see if it would be helpful. thanks
 
Have you sent him a notice, certified return receipt, warning him of the danger it presents to others and his breach of contract? Start with that and (1) fix the dangerous situation, (2) finish the job immediately, or (3) return all your money within X days. You may want to consider withholding money as well for expenses you may have incurred keeping the area safe and secure, which you should do in order to prevent yourselves from getting sued when someone gets hurt.
