A couple of weeks ago I was involved in accident; this is what took place: On a Monday night a couple of weeks ago my girlfriend, her cousin, her cousins boyfriend, and I made a late trip to the local grocery store to grab a movies and some groceries. (I was the driver and owner of this vehicle) Once we got to the grocery store, the girls got out and went into the store, the cousins boyfriend and I stayed in the car. The boyfriend asked if could test drive my car while we were waiting for girls and I gave him permission to do so. He jumped in drivers seat I jumped into the passenger seat. We then started driving around this shopping complex for the next ten minutes or so. On the last lap around the complex the boyfriend hits black ice, loses control of my car and we end up going over the curb of an island and hitting a tree. This is where the situation gets complicated...There was no damage done to the tree or and injuries to ourselves. The front bumper of the car was smashed along with major damage to the right front passenger wheel base and axle and scratches. The car was still drivable I told him to run back to the store and tell the girls what just happened. I then drove the car off the island back in to the street to address the damage to my car and the island. My vehicle is a 2008 Audi A4 (probably poor judgement to let someone I just met drive my car) It turns out the boyfriend is not even 16 with a valid drivers license, but 15 and a half with drivers permit. The police were not called and no reports has been filed yet. The boyfriend lives in Colorado making matters even worse! The car was still drivable in fact there was no damage to the engine at all. After taping up the bumper, and grabbing the girls I drove the car back to my girlfriends house which was nearby. The boyfriend flew back to Colorado the next day. I submitted my claim to my insurance, which I have full coverage on the car and the vehicle is being repaired as we speak. I have spoken with the father of the boyfriend and after a lot of hoops, they have agreed to pay the deductible (500) and call it a day. When I spoke with the father recently, he was absolutely unreasonable period! He went on to state he is going to everything possible to make sure this accident never shows up on his driving record because the cost to insure would be substantial. I asked him, so your son is just going to walk away from this "scot" free like it never happened...The father who apparently is an auto insurance agent said my insurance covers the car first which is being completely repaired, the driver is secondary...as far as he is concerned the case is done "It is what it is" He said yeah your rates are going to go up thats not my problem, if you don't get into any accidents for the next three years then the claim will dissappear of your record. I called my agent the next day to make sure the boyfriends name was attached to this claim and would remain that way, I want to do whatever it takes to make sure this claim stays on his record. Should I file a police report, and is there any other legal advice I should in terms of liability and claims when dealing with a situation like this?
