I'm getting a divorce and moving in with friends out of state. My friends are worried that my soon-to-be ex-husband could claim I cheated on or abandoned him, even though it was his idea for me to move in the first place. The papers have been filed and he is going to sign the Waiver of Service. Would anything my husband say cause problems for the people I will be living with? Would he be able to take legal action against me and them for moving in with them and accuse me of cheating on or abandoning him?
 
What did you state the reason for the divorce in the divorce papers? This sounds like irreconcilable differences. Once the divorce is filed I don't think you can go back and say you're getting a divorce per adultery—Since the papers should already be filed
 
There wasn't a section in the papers asking why, but yes, it is irreconcilable differences. He wouldn't claim that as the reason for the divorce later, but my friends are worried that he would attempt to take legal action against them and me. They think that just because everything is civil now, once I'm gone, he might change.
 
What would he sue for? because you dont want to be w. him any more? and what would he sue them for? giving you a place to live? Let him sue, on what grounds-- I would not worry about it. anyone can sue any body for what ever they want-- the question is -- if the judge agrees-- and I think suing someone because they dont want to be with them anymore is crazy. I may be wrong, but it is just silly.
