Our upstairs neighbor is elderly and accidentally left her sink running - which flooded her bathroom and did major damage to our condo. So far we've sustained approx $25k in damages.
We've gone through our own insurance who is covering up to the maximum of our policy which is only around $10k. We're told that they'll subrogate the total amount of our loss through our neighbor's insurance - but how do we know that they'll fight on our behalf for the extra $15k that we're out? If they don't, do we sue our insurance co. or what is our legal protection?
