I am going in to a meeting tomorrow A.M. concerning a posible disiplinary action concering my performance. Is it my legal right to have a voice recorder on the desk in front of all those present ? If not, can I ask for the meeting to be posponed until I gan bring in an unbiased witness?
Also is it a violation of my rights for any non-involved staff to already be told any information concerning any incedents pending investigation? An employee, during their yearly evaluation today, was only told that I was no longer employed there. I have not even met with HR concering any actions or incedents, other that being told of a meeting I was to be present for concerning a possible incedent. I was relieved of my shift tonight & was told when I asked, if my job was in jepordy, he responded "yes" & that I would not be paid for tonights shift if I was found to be guilty of any wrong doing & I would be paid if I was found innocent. Are there any other issues I should be aware of concerning my rights as an employee working in the State of Colorado...Thanks for the help....

This assumes that you are not a member of a union.

Is it my legal right to have a voice recorder on the desk in front of all those present ? No, it is not. You have no legal right to record the meeting.

If not, can I ask for the meeting to be posponed until I gan bring in an unbiased witness? You can ask but they have no legal obligation to agree. They can say no, it will be legal, and you will have no recourse.

Also is it a violation of my rights for any non-involved staff to already be told any information concerning any incedents pending investigation? No. You have no legal expectation of privacy rights in the workplace with limited exceptions that do not apply here.
