I am named on an apartment lease with my boyfriend, however, I do not reside at that residence. I live in my own house. I was only added to the lease because my b/f needed a co-signer.

I was spending the night with him one night and the cops busted in with out a warrent. They coerced me to sign a "consent to search" because my name is listed on the lease and I was the only girl and it's eariser to bully a girl. (and they did)

My boyfriend (who is also on the lease) was present at the time and wasn't aware that the cops were trying to get me to sign the consent to search form as the cops took me to a seperate room alone to make me sign it.

Can we (my b/f and I) have this consent to search form thrown out due to the fact that I do not reside at the location that I consented to have searched and based on the fact that the other lease holder was present and not notified?

When you sign a lease jointly, you are accepting full responsibility for anything…………..even if you don't live there. Just one person can give permission to search.......Your argument is not strong and I don't think it would work in court…….The least you can do is try……….
