*All fields are hypothetical*
(Tennessee)
My roommate and I were in the possesion of 24 beers. We had two friends over in our University of Knoxville residence dorm. We were all drinking and watching the TV. Three RA's
(residence assistants knocked on our door. We panicked and hid all the beer. The Ra's asked if they "can" enter. My roomate said yes. They asked if we had hidden any beer. My roomate answered "yes". He showed them where we had hidden the beer. The RA's then asked if they "can" see the fridge. He complied and they made him pour it out. They wrote us up, and we are scheduled to see judicial affairs. We were all underage, and University of Tennessee is a dry campus.

#1 Question: Since they used the term "can" doesn't this techincally mean are they able?
#2 Question: None of us had a beer in hand. It was only in the fridge and hidden. They didn't take any cans for evidence. Can they still legally pin us with it?
#3 Question: What should our arguments consist of?

You allowed them to search; you have no expectation of privacy in a dorm room.

It means they asked for - and received - consent to take a look.

Yes. This will be an administrative inquiry and not a court of law - the same rules do not apply. Plus, testimony *IS* evidence.

#3 Question: What should our arguments consist of?
An apology, and a solemn promise not to do it again.
